If I left my spouse in my Will, but we later get divorced, does my ex-wife/ex-husband still receive under my Will?
No. There is a presumption in the law that you wanted to cut out your spouse but you forgot or did not get around to changing your Will to reflect your wishes. Therefore, all the gifts and benefits in favor of the ex-spouse are revoked by operation of law. The divorce must be final and valid for this legal presumption to apply.
