What are the advantages to a separation agreement?
A separation agreement is entered into before a divorce. If the parties are not ready to officially divorce, a separation agreement may be an attractive alternative to divorcing immediately. In addition, this time period in between the separation and the divorce enables couples to continue to take advantage of some of the advantages to being married such as staying on a spouses health care insurance, filing joint income taxes, and other benefits. Separation Agreements used to be the only no-fault way to get a divorce in New York. However, this changed with the New York no-fault law that went into effect in October 2010. Although, this law may decrease the popularity of separation agreements, they still offer certain advantages that should be considered by a couple interested in separating or getting a divorce.
